But, we have a legacy of operating as a 501 c 4 since 1982 under EIN56-1644047. That is 44 years of successful operation in the non-profit world and serving our wonderful community. We are proud to have made the transition and our 501 c 3 EIN is 39-3787813.

To help better understand the switch, LaVern OxenDine provided the best explanation.

While both are tax-exempt, the shift changes the festival’s DNA from a social welfare organization to a charitable organization.

1. The Power of Tax-Deductible Giving

Under the old 501(c)(4) status, if a local business or individual gave $1,000 to the festival, they couldn't write it off on their taxes as a charitable gift.

The Change: As a 501(c)(3), every dollar donated by the public is now tax-deductible.

The Impact: This makes it much easier to solicit high-level sponsorships and individual "Friend of the Festival" donations, as donors get a direct financial benefit for their generosity.

2. Unlocking "Gatekeeper" Grants

Many large private foundations and government grant programs (like the National Endowment for the Arts) have strict bylaws that only allow them to give money to 501(c)(3) entities.

The Change: The festival can now apply for arts, culture, and community development grants that were previously off-limits.

The Impact: This diversifies their revenue so they aren't solely reliant on ticket sales, vendor fees, or beverage sales.

3. Stricter Transparency (The "Suarez" Commitment)

A 501(c)(3) is held to a higher standard of public accountability. They must prove that they exist for charitable, educational, or literary purposes.

The Change: They must limit their lobbying and political activity significantly compared to a (c)(4).

The Impact: As mentioned in the release, this reinforces "transparency." The community can trust that the funds are being cycled directly back into the mission of the festival and the city.
