Terms & Conditions for Vendors
EVENT HOURS (Street Fair)
Saturday, Noon to 6 p.m.*
Sunday, Noon to 6 p.m.*
*On-Street vendors are able to stay open on Saturday until they decide to close. Most vendors stay open until the street lights come on.
EVENT HOURS (In Festival Park)
Thursday, 5 p.m. to 10 p.m.
Friday, 5 p.m. to 10 p.m.
Saturday, Noon to 10 p.m.
Sunday, Noon to 10 p.m.
BREAKDOWN - Breakdown begins Sunday at the end of event hours and no sooner. This is a rain or shine event. Vendor agrees to keep his/her booth in tact during the entirety of the festival no matter the weather conditions. Early breakdown will result in a breach of this contract and the Vendor will not be allowed to participate in future events.
VENDOR FEES - Vendor agrees to pay Organizer fees associated with vendor space. Vendor shall not transfer or sublet the space or any part thereof or permit the same to be used by any other person without the consent of the Organizer. Set up is not permitted until all fees are paid in full. Fees are non-refundable, non-transferable, for any reason, at any time.
COMMUNICATION - Vendor agrees to provide accurate contact and communication information. Vendor agrees to check communication often and respond in a timely manner.
TENT REQUIREMENTS - All tents are required to be weighed down with sandbags. All tents must have proof that they are treated with fireproof chemicals. Vendors using warming or cooking devices must have a charged fire extinguisher, with current inspection sticker (minimum 10-15 lbs. dry powder or CO2) visible in the booth. All vendors will be inspected by the City Fire Marshal.
BOOTH HEIGHT - Vendor agrees that booth height, including signage, will not exceed 12 feet.
SECURITY - Organizer provides a limited amount of security during the festival hours and after the festival has closed each day. However, security is the responsibility of the Vendor. Organizer will not be responsible for damage, theft, or loss during the event for any reason.
REPRESENTED BRAND - Only the item(s) specified in the application are allowed to be represented at booth during the Event. No changes may be made without prior consent of the Organizer. Vendor shall not display, sell, or dispense any items consisting of offensive, discriminatory, or profane language. The display, sale, or dispensing of these or any other items, which in the opinion of Organizer are inconsistent with the mission will result in the removal of vendor
VEHICLES - Vendor agrees that once the festival is open that no vehicles will be driven into the festival footprint during the entire run of the festival. THERE ARE NO EXCEPTIONS. Bringing vehicles into the festival footprint will result in the closing of your booth area and expulsion from the festival.
PARKING - Vendors and their staff are responsible for their own parking. Vendors should anticipate that there may be a cost for parking for your staff during the festival and on a daily basis. The North Carolina Dogwood Festival is not responsible for parking or the fees incurred while parking during the festival.
DESIGNATED AREAS - Vendor booth location is specified at check in. Vendor agrees to use only designated area during the entirety of the festival. Vendor agrees that there is no hawking, soliciting, peddling.
NOISE AND MUSIC - Vendor agrees not to play any music in their area.
TRASH & CLEAN UP - Vendor agrees that the allocated space will be left in original condition as upon arrival. Vendor agrees to proper disposal and pick up of all trash, cardboard boxes, food trash, paper litter, etc.
ELECTRICAL - Electricity is allocated based on Vendor's application request. Vendor must specify at the signing of the contract electricity needs in specific detail. No more electricity will be provided once vendor has met their requested amount. Vendor agrees to operate all electrical equipment, including but not limited to, lights and attachments in a safe, intelligent manner. Organizer cannot be held responsible for accidents caused by Vendor not appropriately using provided electricity. Vendor agrees to provide a UL listed 100 foot, 12 gauge, 3 prong grounded outdoor rated extension cord for use with regular duplex receptacles. Vendor agrees that if the equipment you operate trips electrical breaks more than once, that you will not be connected to electricity.
TAXES - Vendor is responsible for collection of taxes in accordance with Cumberland County sales tax codes.
INDEMNIFICATION - Vendor will indemnify and hold Organizer harmless from all costs, losses, damages, or expenses including the expense of litigation and attorney's fees, resulting from any person or property arising out of any act of omission of Vendor of his/her employees or other representatives. The North Carolina Fayetteville Dogwood Festival, its board of directors, staff, officers, agents, or members shall not be held responsible for any loss or damage due to theft, fire, accident, or other cause, but will use reasonable care to protect Vendor from such loss.
TERMS & TERMINATION OF RIGHT - Upon signing Contract, the Vendor agrees to abide by the Terms and Conditions set forth herein and included in this Contract. Vendor agrees to have terms and conditions posted within the vendor area/booth at all times. Vendor agrees all employees and volunteers working within the designated area agree to these same terms and are knowledgeable while adhering to the rules at all times. Organizer reserves the right to terminate operation of Vendor during the Event for any reason at any time.
TERMS BELOW APPLY TO FOOD VENDORS ONLY:
STORMWATER MANAGEMENT & GREASE DISPOSAL - All food vendors are responsible for paying a $500 Stormwater Management deposit. Vendor will be held liable for any grease spill on or around vendor's designated area including point of sale, concrete and/or grass. Mats, tarps, or other coverings must cover the entire designated area. Vendor is responsible for the removal of all grease and/or grease products from the festival. Any disposal of waste into the storm drains will result in the forfeit of vendor Stormwater Management deposit and a permanent ban from the festival. Vendor agrees to pay Management Deposit as listed above in this contract no later than April 1. Organizer agrees to hold this deposit in escrow and refund it in full upon the complete inspection of vendor space by a Dogwood Festival Board Member and the Stormwater Inspector. This amount will be refunded minus any fines no later than 10 days after the festival. Vendor agrees to submit Stormwater Management Deposit by check to: PO Box 1321 Fayetteville, NC 28302.
GREYWATER TANKS - Vendor agrees to use greywater tanks for the proper disposal of greywater. Vendor agrees to provide their own method of transporting greywater to tanks for proper disposal. Vendor agrees to not dispose of greywater into the storm drains. Vendor agrees to not pour grease into greywater tanks.
HEALTH INSPECTIONS - Vendor agrees to allow The Cumberland County Health Inspector to inspect the designated area prior to opening or during the festival. Vendor agrees to abide by The Cumberland County Health Department's guidelines available through their website. =
ADVERTISED PRICING - Vendor agrees to post food prices for all items being sold in booth, including beverages, in a visible and legible manner. Pricing must be seen from a distance of at least 15 feet from booth edge. Prices will remain posted for the entirety of the festival.
BEVERAGE AND ICE - Vendor agrees to only vend the festival official PEPSI brand and all items that fall under the PEPSI name. Vendor agrees to purchase PEPSI items directly from the festival. Vendor agrees to purchase ice directly from the festival, in cash, on a pay-as-you-go basis. Vendors agree to pick up their items from PEPSI and Ice trucks. Vendors agree to not sell fountain drinks.
WATER - Upon request, Vendor will be provided a direct water hookup. Vendor agrees to provide food grade hoses (minimum of 50 feet) and food grade connectors.
